These Terms and Conditions ("Terms") govern your access to and use of www.bentleysapothecary.com and any related webpages, online store, customer accounts, rewards program, content, products, and services operated by Bentley's Apothecary, doing business as Bentley's Apothecary ("Bentley's Apothecary," "we," "us," or "our").


Please read these Terms carefully. By accessing the website, creating an account, enrolling in the Rewards Program, or placing an order, you agree to these Terms and to any policies incorporated into them by reference. If you do not agree, do not use the website or purchase products through it.


1. Eligibility


You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, enroll in the Rewards Program, or place an order. If you permit a minor to browse the website, you are responsible for supervising the minor's use.


By using the website, you represent that the information you provide is accurate and that your use complies with applicable law.


2. Educational and Product Information


Information on this website - including articles, product descriptions, traditional-use information, recipes, testimonials, blog posts, social-media content, and information about herbs, botanicals, essential oils, cosmetics, or dietary supplements - is provided for general educational and informational purposes.


This information is not medical advice and is not a substitute for diagnosis, treatment, or advice from a qualified healthcare professional. We do not represent that any product will diagnose, treat, cure, mitigate, or prevent a disease.


Unless a product's label expressly states otherwise:


- do not ingest essential oils or products intended only for topical or aromatic use;

- use products only as directed on their labels;

4. Product Information and Availability


We make reasonable efforts to present product descriptions, ingredient information, photographs, colors, sizes, quantities, and pricing accurately. Natural and handmade products may vary in color, scent, texture, appearance, or consistency from batch to batch. Screens and devices may also display colors differently.


We do not promise that every description, image, or other website element will be entirely error-free. We may correct errors, update information, discontinue products, impose quantity limits, or change product availability when reasonably necessary.


Product availability is not guaranteed. Placing an item in a cart does not reserve it.


5. Orders and Acceptance


Your submission of an order is an offer to purchase the products listed in the order. An automated order acknowledgment confirms only that we received the order; it does not necessarily mean that we accepted it.

Prices are shown in U.S. dollars unless otherwise stated. Prices, promotions, and availability may change before an order is accepted. The price charged will be the price shown during checkout, subject to correction of an obvious error as permitted by law.


Applicable shipping charges, taxes, and other disclosed fees will be presented at or before checkout. You authorize us and our payment processors to charge the payment method you provide for the total displayed at checkout.


You represent that you are authorized to use the payment method submitted with an order. Payment information may be processed by third-party payment providers under their own terms and privacy practices.


Promotional offers may be governed by additional terms. Unless expressly permitted, promotions, discounts, coupons, and rewards cannot be combined.


7. Shipping and Delivery

Any stated processing or delivery date is an estimate unless we expressly identify it as guaranteed. Delays may occur because of carrier operations, weather, supply issues, incorrect addresses, holidays, or events outside our reasonable control.


We will ship within the period stated at checkout or in our Shipping Policy. If no shipping period is stated, we will handle the order consistently with applicable law. If we cannot ship within the represented period, we will provide any delay notice, cancellation opportunity, or refund required by law.


Customers are responsible for providing a complete and accurate shipping address. Contact us promptly at contact@bentleysapothecary.com if an address needs correction. We cannot guarantee that an address can be changed after fulfillment begins.


Responsibility for loss or damage during delivery will be determined under applicable law and our Shipping Policy. Nothing in these Terms limits rights that cannot lawfully be limited.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account to the extent permitted by law. Do not share your password or reuse a password that has been compromised elsewhere.


Notify us promptly at contact@bentleysapothecary.com if you suspect unauthorized access to your account. We may suspend or restrict an account when reasonably necessary to investigate suspected fraud, protect the website or other users, comply with law, or address a violation of these Terms.


We may require additional verification before changing account information, releasing account details, or processing certain transactions.


10. Personal and Noncommercial Use; Resale


Products sold through the website are generally offered for personal or household use unless we have entered into a separate written wholesale or authorized-reseller agreement.


You may not purchase products through the website for unauthorized commercial resale, diversion, relabeling, repackaging, tampering, or for making false or misleading representations about Bentley's Apothecary or its products.

- impersonate another person or misrepresent your identity or affiliation;

- use another person's payment information without authorization;

- submit content that infringes intellectual-property, privacy, publicity, or other rights;

- make false, deceptive, or unauthorized health claims about our products;

- manipulate the Rewards Program, reviews, promotions, or checkout process;

- use our content or trademarks in a way likely to cause confusion about sponsorship, affiliation, or endorsement; or

These restrictions do not prohibit lawful consumer reviews, commentary, comparative advertising, fair use, or other activity protected by law.


12. Intellectual Property


The website and its original text, graphics, photographs, product descriptions, artwork, logos, page design, and other content may be protected by copyright, trademark, trade-dress, or other intellectual-property laws. Rights may belong to Bentley's Apothecary, its licensors, photographers, authors, suppliers, or other owners.


Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to access and use the website for personal, noncommercial purposes.


Except as permitted by law or with the relevant owner's written permission, you may not reproduce, distribute, modify, sell, publicly display, create derivative works from, or commercially exploit protected website content.


"Bentley's Apothecary," its logos, product names, and related brand features may function as trademarks. Do not state that a mark is federally registered or use the ® symbol unless a current registration has been confirmed for the relevant mark and goods or services. No trademark license is granted except for nominative or other lawful use.


A statement that content is copyrighted does not mean every item has been registered with the U.S. Copyright Office. Copyright protection and copyright registration are distinct.


13. User Submissions, Reviews, and Feedback


If you submit a review, photograph, comment, testimonial, suggestion, or other content ("User Content"), you retain any ownership rights you have in it. You grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that User Content for operating and promoting Bentley's Apothecary, subject to applicable law and our Privacy Policy. This license ends when the User Content is deleted from our systems where reasonably practicable, except for material already used in lawful archived materials or as otherwise required by law.


You represent that:


- you created the User Content or have permission to submit it;

- it reflects your honest opinion and actual experience;

Do not include private health information or other sensitive personal information in a public review. Testimonials describe individual experiences and do not guarantee that another person will have the same result.


Unsolicited product, marketing, or business ideas are not confidential unless we expressly agree otherwise in writing.

We may temporarily suspend, restrict, update, or discontinue website functions for maintenance, security, legal, operational, or business reasons.


17. Disclaimer of Warranties

18. Limitation of Liability


TO THE FULLEST EXTENT PERMITTED BY LAW, BENTLEY'S APOTHECARY AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE, INCLUDING LOST PROFITS OR LOST DATA, WHEN SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.


TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

Your continued use of the website after updated Terms take effect constitutes acceptance of the updated Terms. Changes to an order already accepted will not retroactively alter that order unless you agree or the change is required by law.


22. Suspension and Termination

If product-specific terms conflict with these general Terms, the more specific terms control for that product or transaction, subject to applicable law.


24. Bentley's Apothecary Rewards Program


24.1 Eligibility and Enrollment


The Bentley's Apothecary Rewards Program ("Rewards Program") is available to legal residents of [UNITED STATES / ELIGIBLE AREA] who are at least 18 years old and maintain an eligible customer account.


Enrollment is free unless we clearly disclose otherwise. Customers are enrolled only through the process displayed on the current website, such as [CHECKING AN ENROLLMENT BOX / CLICKING "JOIN REWARDS" / CREATING AN ACCOUNT AFTER CLEAR DISCLOSURE]. Creating an account does not automatically enroll a customer unless that fact is clearly disclosed and the website is configured accordingly.


No purchase is necessary merely to enroll. A purchase may be necessary to earn purchase-based points.


24.2 Earning Points


Members earn points on eligible purchases at the rate shown on the Rewards Program page.


Proposed rate from the prior program - confirm before publishing:

Unless otherwise stated, points are calculated on the eligible product subtotal after discounts and before taxes, shipping charges, tips, gift-card purchases, returns, and excluded products.

We may offer bonus-point promotions with separate eligibility periods and conditions. Promotional points may take [NUMBER] days to appear.


24.3 Rewards and Redemption


Points may be redeemed for rewards shown in the member's account or on the Rewards Program page.


Proposed value from the prior program - confirm before publishing:

Rewards may be subject to a minimum purchase, expiration date, product exclusions, or single-use restriction if those conditions are disclosed before redemption.


The prior statement that 1,400 points equal a $50 reward is inconsistent with a rate of $10 per 200 points. At that rate, 1,400 points would equal $70. Do not publish either maximum until the intended redemption schedule is confirmed.

Unless expressly stated otherwise:


- only one reward may be used per order;

- rewards cannot be combined with other coupons or promotions;

24.4 Returns and Cancellations


If an eligible purchase is returned, refunded, canceled, reversed, or disputed, points associated with that transaction may be removed. If a redeemed reward was connected to a returned purchase, the reward or related points will be handled as described in [REWARDS FAQ / RETURN POLICY].


A points balance may become negative if points were redeemed before the underlying transaction was reversed. We may offset a negative balance against future points.


24.5 Expiration and Account Closure

24.6 Program Abuse


We may withhold, reverse, or cancel points or rewards obtained through fraud, manipulation, duplicate accounts, unauthorized purchases, returns abuse, false information, or other material violations of these Terms.


We may combine duplicate accounts belonging to the same person or request reasonable verification before issuing or redeeming rewards. Decisions will be based on the program records available to us, subject to correction of documented errors and applicable law.


24.7 Program Changes or Termination


We may modify or end the Rewards Program for legitimate business, operational, security, or legal reasons. For material changes affecting earned points - such as reducing their value, adding an expiration period, or terminating the program - we will provide reasonable advance notice and, when reasonably practicable, an opportunity to redeem existing points before the change takes effect.


Immediate changes may be made when reasonably necessary to prevent fraud, address security concerns, comply with law, or correct an obvious error.


Earned points do not create property rights and have no cash value, except where applicable law requires otherwise.


24.8 Taxes


Members are responsible for taxes, if any, arising from rewards they receive. We may request information or issue tax reporting documents if required by law.


24.9 Rewards Support


Questions about points or rewards should be sent to contact@bentleysapothecary.com with the member's name, account email, order number, and a description of the issue. Do not send passwords or full payment-card information.

Return and Refund Policy

SHIPPING, CANCELLATIONS, RETURNS, AND SEASONAL HEAT POLICY

OVERVIEW


Thank you for shopping with Bentley's Apothecary. Our products are handmade or made to order, and we take care in preparing and packaging each order.


This policy applies to orders placed directly with Bentley's Apothecary. Nothing in this policy limits any rights or remedies that cannot lawfully be waived under applicable federal, state, or local law.


WHERE WE SHIP


We currently ship only within the United States and eligible U.S. destinations served by our carriers. We do not offer international shipping at this time.


Orders are shipped through USPS or UPS using the services available at checkout.

PROCESSING TIME


Processing time is the time needed to make, prepare, package, and transfer an order to the carrier. It is separate from the carrier's estimated transit time.


Our current estimated processing time is 2 to 7 business days after we receive a complete order and payment. Business days do not include weekends or federal holidays. Handmade, made-to-order, customized, large, or high-volume orders may require additional time.

To reduce packaging and transportation waste, we generally ship all items in an order together. If an order includes an item that requires more preparation time, the entire order may wait until all items are ready. SHIPPING AND DELIVERY ESTIMATES


Carrier transit estimates begin after the carrier accepts the package. They do not include Bentley's Apothecary's processing time.


Shipping services and estimated transit times shown at checkout are estimates provided for planning purposes. They are not guaranteed delivery dates. Weather, seasonal volume, carrier disruptions, incorrect or incomplete addresses, and other circumstances outside our reasonable control may affect delivery.

SHIPPING CHARGES


Shipping charges, if any, are displayed at checkout before the order is submitted.

ORDER TRACKING


When tracking is available, a shipping confirmation and tracking number will be sent to the email address provided with the order. Tracking information may take time to update after the label is created or the package is accepted by the carrier.


A shipping confirmation means the order has entered the fulfillment or shipping process. It does not guarantee delivery on a particular date.


SHIPPING DELAYS


We make shipment estimates in good faith based on information reasonably available when an order is accepted.


If we learn that we cannot ship within the time stated for the order, we will provide any notice, cancellation option, request for consent to a delay, and refund required by applicable law. If we cannot fulfill an order, or if a customer does not agree to a delay when consent is required, we will cancel the affected order or item and issue the required refund.


Carrier delays that occur after a package has been shipped may affect delivery estimates. We will provide reasonable assistance when information or action from the shipper is needed for a carrier inquiry or claim.


ORDER CANCELLATIONS


You may request cancellation before fulfillment or shipping begins by using any cancellation feature available in your customer account or by contacting us at contact@bentleysapothecary.com.


A cancellation request is not complete until Bentley's Apothecary confirms it. We cannot guarantee that we can stop an order once preparation, fulfillment, or shipping has begun. Orders that have shipped cannot be canceled as unshipped orders.


This cancellation policy does not limit a customer's right to cancel because of a shipping delay or any other right provided by applicable law.


Approved cancellation refunds will be returned to the original payment method unless otherwise required by law.

We cannot guarantee that an address can be changed after fulfillment begins or a shipping label is created. We will not redirect a package in a manner prohibited by the carrier or when we cannot reasonably verify the request.

LOST, MISSING, OR STOLEN PACKAGES


If tracking has not updated for an unusual period, or if a package is marked delivered but cannot be located, contact us at contact@bentleysapothecary.com with the order number and tracking number.


Customers should also check the delivery location, household members, neighbors when appropriate, building management, and any carrier delivery notice. Please report suspected theft to the appropriate local authority when warranted.


Carrier claim procedures vary by service and coverage. USPS permits either the sender or recipient to file certain insured domestic claims, while UPS may require action or documents from the shipper in some cases. Please keep all relevant records and cooperate with reasonable carrier investigation requests. Bentley's Apothecary will provide reasonable assistance when the carrier requires the shipper of record to act.

RETURNS AND EXCHANGES


Because many Bentley's Apothecary products are personal-care, cosmetic, topical, or ingestible goods, we generally do not accept discretionary returns or exchanges, including returns based on a change of mind, personal preference, or an accidental order.


This restriction helps protect product safety, quality, and hygiene. It does not apply when Bentley's Apothecary sent the wrong item, an item arrived damaged or defective, or a return, replacement, refund, or other remedy is required by applicable law.


DAMAGED, DEFECTIVE, OR INCORRECT ITEMS


Please inspect your order promptly after delivery. If an item arrives damaged, defective, leaking, unusable, or different from what you ordered, contact us within 5 calendar days after delivery at contact@bentleysapothecary.com.

Your name and order number


A description of the problem


Clear photographs of the item, shipping container, shipping label, interior packaging, and any visible damage


Any other information reasonably needed to evaluate the issue or support a carrier claim


Keep the product, shipping container, and all packaging until we tell you they are no longer needed. A carrier may require inspection or photographs.


After reviewing the information, Bentley's Apothecary may offer an appropriate replacement, refund, or other remedy. The available remedy may depend on the circumstances, product availability, and applicable law.


The 5-day reporting request helps us investigate promptly and meet carrier deadlines. It does not eliminate rights or remedies that cannot lawfully be limited or waived.


REFUNDS


Approved refunds will be issued to the original payment method unless otherwise required by law. We will refund shipping charges when required by applicable law, including when an entire unshipped order must be canceled under applicable shipping rules.

SEASONAL HEAT POLICY


Some natural products, including balms, body butters, salves, and certain liquid or oil-based products, may soften, melt, liquefy, or separate during warm-weather transit. These changes may affect texture or appearance even when the product remains otherwise usable.


During periods of high heat, Bentley's Apothecary generally ships heat-sensitive orders Monday through Wednesday to reduce the chance that packages will remain in a carrier facility over a weekend. This schedule may add processing time. We may also recommend or offer an upgraded shipping service, but expedited transit does not guarantee that a product will remain cool or solid.


We do not include ice packs or freezer packs. These packs often thaw during transit, can introduce moisture, and do not guarantee temperature control.


Arrange for prompt delivery when possible, monitor tracking, and bring the package indoors as soon as it arrives. Avoid leaving products in a mailbox, vehicle, direct sunlight, or another hot location.


WHAT TO DO IF A PRODUCT MELTS OR SEPARATES


Carefully open the package and keep the container upright.


If the container is intact, place the product in a refrigerator for approximately 30 minutes or until it becomes firm. Do not freeze unless the product's directions specifically permit freezing.


If a balm or butter has separated, gently stir it with a clean, dry utensil when safe and practical, then chill it until the texture firms.


Do not use a product if its container is broken, its seal is compromised, it leaked in a way that may have contaminated it, or the product appears unsafe.

Heat-related concerns will be reviewed based on the condition of the item, the shipping circumstances, the product's disclosed characteristics, and applicable law. Nothing in this policy excludes a remedy required by law.
